On May 28, 2007 Powermark Homes filed a Civil Lawsuit against our original website PowermarkHomes.Net but before the website's author had obtained legal counsel the Powermark Homes attorney's filed a DMCA Copyright Infringement Claim and had the website shutdown. With numerous unresolved motions pending before the court, Greg Beck with Pubic Citizen Notified Judge McCormick of John Doe's intention to put the website back online at the new address PowermarkHomesSucks.Com on July 30, 2007. In their 1st DMCA Copyright Infringement Claim Powermark Homes claimed about part of a photo that was obtained from their website powermarkhomes.com and used in a Flash File on the home page of our original website PowermarkHomes.Net. When PowermarkHomesSucks.Com went online a link was provided to their Exhibit "A" which was entered it into evidence in the Civil Lawsuit Powermark Homes filed against John Doe and Domains By Proxy. Powermark Homes lawyers then waited 2 months and filed a 2nd DMCA Copyright Infringement Claim and had our web site shutdown again on October 8, 2007, this time over the link we provided to their Exhibit "A" Perhaps they did this because it was a copy of the Flash File which apparently offended them or they just didn't want you to see. However, this time John Doe had legal counsel thanks to the Public Citizen Litigation Group and Powermark Homes' second attempt to silence this website backfired because our attorney Greg Beck filed a Counter Notification and our website back online on October 23, 2007. Now the "64 Million Dollar Question" is: Are Powermark Homes lawyers arrogant enough to file lawsuits against the "60+" websites listed below and their anonymous bloggers in an effort to silence all of their critics? |
